GENERAL: The applicant appeals for upgrade of discharge to honorable.

The applicant appeared and testified before the Discharge Review Board (ORB), with counsel, via video teleconference between Andrews AFB Maryland and Travis A FB, CA on September 25, 2014.

The attached brief contains available pertinent data on the appl icant and the factors lead ing to the discharge.

FIN DING : The Board denies the upgrade of the discharge.

ISSUE: A pplicant recei ved an Under Other Than Honorable Cond itions discharge - Chapter 4 In Lieu of Trial by Court Mariial.

The Air Force Discharge Review Board, under its responsi bi l i ty to examine the propriety and equity of an Appl icant's discharge, is authorized to change the character of service and the reason for discharge if such change is warranted. In reviewi ng discharges, the Board presumes regu larity in the conduct of governmenta l affairs unless there is substantial credible evidence to rebut the presumption, to include evidence submitted by the applicant. The Board did complete a thorough review of t he circumstances that led to the discharge and the discharge process to ensure the discharge met the perti nent standards of equity and prop1iety.

The appl icant contends the discharge was inequitable because it was too harsh. The records indicated the appl icant requested and recei ved a Chapter 4 In Lieu of Trial by Court Martial for charges of child abuse.
The Board finds the applicant submitted no issues contesti ng the equity or propriety of the discharge, and after a thorough review of the record, the Board was unable to iden tify any that would justify a change of discharge.

A discharge is upgraded only i f the applicant and the Board can establ ish that an inequity or impropriety took place a t the time of discharge. After a thorough review of the record, the Board found no evidence to just ify an upgrade of the discharge.

CONCLUSI ON: The Discharge Review Board concludes that the discharge was consistent with the procedura l and substanti ve requi rements of the discharge regu lation and was within the discretion of the discharge authority and the applicant was provided fu ll administ rat ive due process.

In view of the foregoi ng findings, the Board further concludes that there exists no legal or equitable basis for upgrade of discharge and dctennines the discharge should remai n unchanged.
